In addition to preparing wills, durable powers of attorney, health care powers of attorney, living wills, funding trusts, and trust administration, the firm has a strong background in drafting contractual estate plans, waivers of spousal rights to elect against the decedent’s estate, and revocable and irrevocable trust instruments that cover mitigation of death and transfer taxes, mitigation of income taxation, asset protection, special needs trusts, spendthrift trusts, separation of marital property from non-marital property, and Medicaid planning.
Post-mortem estate planning is available for clients who are not satisfied with a decedent’s estate plan in place at the time of the decedent’s death. Post-mortem estate planning can have a positive outcome on a decedent’s existing estate plan that does not meet the needs of the decedent’s successors due to a change in circumstances, insufficient planning, the age of the estate planning document, etc.
